LB7 DSP switch issue

I tuned a 02' like I have many times over and when I went to switch the tunes running on the dyno its not switching and only staying on the stock tune. So I figured I have a bad switch, switched the tune over to serial data and used my V2 to switch the tunes and it works correctly. I compared the switch resistance to a known good switch and its exactly the same and shows its switching. bad switch? and yes I have triple checked the pin outs 49 and 69 for the wires. any ideas. I'll have a new switch tomorrow.
