There are at least 4 different E38's. Maybe 5+. At least this is the way GM sells them. Though I would guess that the hardware is largely the same prior to its first OS load at the factory...with some exceptions.
Ross outlined the why's of lack of forward/backward compatibility from '09 on in another post.
I need to update it! It doesn't include 2010.

I had a quick look but I could not find it.
In short, IIRC, in my own words, it is the way the different OS's use the area of flash that is used to store various semi permanent items outside the cal segments like throttle learn? trim info? VIN, etc etc etc., and when a late OS has configured this space and an earlier OS might be loaded in or vice versa and it goes to look for its safely stored data in its safely structured "database", it finds incorrect/out of range data, cant deal with it, and it swallows its tongue.
Like a divide by zero, total awareness is acquired, it understands life the universe and everything, and goes off to park cars at the end of the universe for a million years or so........and finds that the answer is still "42". And terminates.

"There is several problems. GM have changed the structure of an important part of the ECM that stores the VIN, theft codes, misfire learning etc 4 times since 2006. That area is never written to by EFILive (or TechII) so if you update to an OS that does not use the same structure then when the ECM reboots it will corrupt itself. This is also why GM now have 4 part numbers for the E38 so dealers must order and use the correct one. On the ACDelco parts website it even states "(E38 NO-START) 8.10.X SW LVL" meaning it's only for 2010 models."
